 Description

The first Agreement with Malagasy dates from 1986. The current Fisheries Partnership Agreement between the European Union and Malagasy covers the period from 1 January 2007 to 31 December 2012, which is renewable. The current Protocol was initialed on December 23, 2014 and entered into force on January 1st, 2015 and is valid until December 31st, 2018 and has a financial contribution of 1,566 250€ per year for the first two years and 1,487 500€ in the last two years.

This FPA is part of the EU FPAs network of tuna agreements negotiated with third countries of Indian Ocean, allowing European Union vessels (Spain, Portugal and France) to fish in Malagasy waters.

 

 Eligibility Conditions:

  • Hold a valid fishing license in accordance with Article 6 of the Control Regulation (Regulation No. 1224/2009)
  • Implementation of the relevant IMO vessel identification system, if required under Unions law
  • The fishing vessel is not on a IUU vessels list adopted by any RFMO and / or the Union under the IUU Regulation
  • The flag Member State has fishing opportunities under the fisheries agreement in question
  • Have a vessels satellite monitoring system (VMS) installed and operational
  • Have a system for the electronic filling and transmission of fishing logbook data installed and operational.


 Fishing possibilities by gear type

  • Tuna seiners: 40 vessels
  • Surface longliners (more than 100GT): 32 vessels
  • Surface longliners (equal or less than 100GT): 22 vessels.

 Required Documents

Each license application shall be accompanied by proof of payment of the fee for the corresponding duration period, or by any other requested document under the specific provisions applicable to vessel’s type concerned under the Protocol.

 

 Cost of the License

For surface longliners (more than 100 GT):

  • 3 600€ per vessel, equivalent to the fees due for 60 tonnes per year, for the first two years of application
  •  4 200€ per vessel, equivalent to the fees due for 60 tonnes per year, for the last two years of application.

 Observers

As requested by the Malagasy authorities, 10% of the total number of European Union fishing vessels, of each fishing category authorized to fish in the Malagasy fishing zone shall be posted by observers. Observers shall be appointed by the competent authorities of Madagascar.

 

 Seamen

Shipowners of vessels operating under the FPA shall take on Malagasy nationals or, failing that, from other ACP countries during the fishing year in the Malagasy fishing zone: Tuna seiners - 2 seamen; Surface longliners (more than 100GT) - 1 seaman.

Shipowners who do not board the minimum number of Malagasy seamen must, alternatively, pay a financial compensation.


 Authorized areas

EU vessels are only authorized to operate in the areas defined in the Protocol.
 

 Reporting Obligations

Masters of EU fishing vessels fishing under this FPA must keep logbooks in accordance with the IOTC Resolutions applicable to longliners and seiners. The master must report the catch by delivering his fishing logs corresponding to the period of his presence in the Malagasy fishing zone to the competent authorities of Madagascar.

In the case of leaving the Malagasy fishing zone without prior passage through a port in Madagascar, the original of each fishing log shall be sent:

  • Within 7 working days of arrival at any other port, in any case 15 working days after leaving the Malagasy fishing zone by post to the address given in Appendix 9 to the Fisheries Protocol
  • The master of the vessel must also send a copy of all fishing logbooks to the EU and to the competent authority of the flag State, and must also send a copy of all logbooks to the Portuguese Institute for the Sea and Atmosphere (IPMA).
     

 Prior Notifications

Masters of fishing vessels operating in the Malagasy fishing zone shall notify the competent Malagasy authorities responsible for fisheries control at least three hours in advance of their intention to enter or leave the fishing zone.
